Starmer and Lammy To Abolish The Ancient Right To Trial By Jury

 

David Lammy, Keir Starmer;s Justice Secretry and Deputy Prime Minister is developing to scrap the right of trial by jury for most crimes despite previously arguing that they are fundamental to democracy.

In documents leaked to the media, the Justice Secretary has proposed juries will only decide upon cases of murder, rape, manslaughter and other serious offences carrying sentences of more than five years. Apparently Prime Minister Starmer, himself a former hunan rights lawyer, supports this latest lunge towards authoritarianism proposed by a member of his government and also the latest in a stream of attacks on the civil rights and liberties of British citizens.

This is just the latest in a stream of totalitarian measures proposed by the labour government. Their flagship policy of introducing mandatory Digital ID to access public services has already been derailed by public opposition. 

The plans for summary justice come as British courts battle a record backlog of nearly 80,000 cases, with many victims of crime waiting years for justice. The documents warn that failure to ease the gridlock could lead to a “wider collapse” of the criminal justice system.

But will the abolition of the ancient right to trial by jury of itself not amount to a collapse of the justice system?

UK Bid To Abandon Common Law Right Of Trial By Jury Is Another Step Towards Technocratic Tyranny

 

Hot on the heels of their voting for new laws permitting euthanasia and decrimnalising late term abortions at any point pre birth, (effectivly legislating the return of back street abortions,) the Labour government revealed plans to reform the UK’s criminal justice system, which include the scrapping of the right to trial by jury for many offences and reduced sentences for those who plead guilty. All are part of a larger agenda that would empower tyrannical authoritarianism hidden behind the mask of human rights.

Former senior judge and current Investigatory Powers Commissioner Brian Leveson was in the news this week for defending the commission's  recommendation of, among other things, “jury-free” trials, in order to “prevent the collapse of the criminal justice system”.

Note the language. “Jury-free“, not “jury-less“, as if juries are a food additive we should avoid, rather than a right guaranteed in British law for over 800 years.

This is not new. “Replacing”, “updating” or otherwise “reforming” Jury trials has been on the globalist agenda for years now.

However the right to jury trial is held in high regard by the public: confidence is retained because ordinary people can be seen to participate equally and to be the guardians. In one sense, it is one of the very few opportunities in which democracy comes to life. Above all, it generates respect for the rule of law – so grossly ignored at present on the global stage. The jury provides, in clearest terms, a conscience. This is particukarly important in cases like the UK-wide 'grooming gang scandal' in which the politicisation of policing and justice have led to political considerstions taking precedence over the protection of the vulnerable from criminals.

There may be quicker ways of dispensing justice (famously parodied by Lewis Carroll in the trial of the Knave of Hearts); even faster and cheaper via AI; also, cheaper ways by inducing quick pleas in exchange for a reduction in sentence. But these do not engender confidence or reliability. An alternative is to restrict the number of cases eligible for trial by jury. Then it can be said it’s not an attack on juries but just a response to exigency. Over time, however, it gets dangerously close to the former.

All of this is completely Illegal under common Law THE ONLY LAW In fact Legislation in contradiction of Common Law is logically Illegal, as its BREAKING the existing Law and any Legislation which is in line with common Law, is completely redundant, why do you need a piece of legislation when the common Law crime already exists to prosecute them ?

Well the answer is simple lets take for example some company poisoning a river, politicians would have you believe the act of poisoning isn’t a crime under common Law (it most certainly is) and that we need them to come to our rescue, the second thing they achieve is lessening the sentence for their mates who own these poisoning companies, instead of a 15 year jail sentence, the new sentence is a small percentage of their profits and a hearty slap on the wrist.

There is not a single wrong doing which cant be dealt with the correct application of Common Law, for those still on the left right hamster wheel (which is not many here thankfully) For the left companies damaging Public property and poisoning rivers, those are crimes under common Law and for those on the right Mass immigration would be considered theft of public land and trespass. You don’t need legislation its nothing more than the public declaration of the criminality of politicians.

Britain's Two Tier Justice System: Police Officer Was Prosecuted For Shooting Gangster Who Drove A Car At Officers While Trying To Escape Arrest

When London Metropolitan Police Officer Martyn Blake fired a single shot through the windscreen of gangster Chris Kaba’s Audi Q8 killing him as he tried to escape after being stopped by police in the South London suburn of Streatham on September 5th 2022 it was inevitable, due to Kaba's colour and ethnic background that the incident would become a big story.

Though the Audi driver's identity was not known at the time, the vehicle had been linked to two previous firearms incidents including a shooting outside a primary school the night before so it was perfectly reasonable for Blake and other officers dealing with the incident to assume the there was a high risk of violence.

Despite this Officer Blake, 40, who had an unblemished record with the Metropolitan Police, was charged with murder with prosecutors claiming his actions had not been “reasonably justified”. That decision to charge him followed a lengthy investigation by the Independent Office for Police Conduct (IOPC) and consideration by the Crown Prosecution Service (CPS).

However following a three week trial at the Old Bailey, duing which Mr. Blake told the court he genuinely feared for the lives of his colleagues, when Kaba attempted to ram his way through a roadblock in a residential street and also tht he had not intended to kill Kaba but had simply wanted to stop the car driving at his colleagues. The jury took three hours to find him not guilty of murder. No doubt jury members were more aware of how ludicrous Britain's two tier justice system's laws covering polivce use of firearms against dangerous criminals are. We all know about the role of guns in policing as used in the USA. However there is not one of the major European nations where an officer would be prosecuted for shooting dead a suspect who was trying to escape from arresting officers or otherwise resisting arrest.

The verdict was naturally greeted with relief by Mr. Blake’s colleagues, friends and family, but will lead to inevitable questions about why he was ever charged in the first place. Despite being cleared of the criminal charge, Mr. Blake could still have to face a gross misconduct hearing which could result in him being sacked. As a fully trained firearms officer, Bloke is being punished for doing his job.

Following the verdict members of the black community and leftists of all races tried to equate the case to the killing of George Floyd in 2020, disorderly with street protests by Black Lives Matter supporters and claims by Kaba's family that the killing was racially motivated and that the known criminal had led a blameless life. A few days after the verdict was announced the trial judge finally lifted reporting restrictions he had imposed in order to prevent race baiters causing such an outcry with their demands for summary justice and assertions that members of minorities cannot be held accountable to the same laws as white people that a fair trial would have been impossible. Only then was it revealed that Chris Kaba was one of London’s most feared gangsters and the police officer who shot him had a £10,000 bounty put on his head. Martyn Blake now is having to live in hiding, fearing for his life and his the lives of his family after a Kana's criminal associates let it be known they are prepared to offer £10,000 for information on his whereabouts in order to kill him in revenge for the death of Kaba. Only now can it be disclosed that the 24 year-old who used a powerful car as a weapon was high on cocaine that night and still had gun residue on his sleeve and a balaclava in his car, providing “strong evidence” that je had carried out a gangland shooting in Brixton the night before, Mr. Blake’s lawyer Patrick Gibbs, KC, said. It was also revealed he was a leading member of the 67 gang, which police consider the most dangerous gang in South London. Just six days before his death Kaba brazenly gunned down a rival in the middle of a crowded nightclub during a bloody feud for control of a profitable county lines drug network. In the shocking attack captured on CCTV, the gangster started blasting at Brandon Malutshi chasing him outside the Oval Space Club in Hackney, with one of the bullets hitting him in the leg. So, the police officer who was named back in March had his life put in danger and has been into hiding – but the judge banned reporting on Kaba’s history, preventing the public having the full picture and allowing the family and community to portray the notorious gangster as an expectant father and aspiring architect with “so much potential” who had been trying to turn his life around. This is obviously no way to keep the public safe or respect the personal risks that law enforcement officers take to protect us. But it shows us once again that there is now a two tier justice system in operation. Leftists have infiltrated all levels of public life and are determined to advance their 'woke' agenda whenever an opportunity is presented, to the cost of the law abiding majority.

The Trump Hush Money Trial - What Has It Been Really About?

 

The long drawn out trial of former Republican President Donald Trump in a New York State court is finally drawing to a close amid much anticipated controversy. While America's far - left Democratic Party are cocksure that Trump will be found guilty on all counts by a jury packed with Democrat Party supporters in a case brought by a Democrat Party activist State Attorney General in a court presided over by by a judge who is a Democrat Party activist and has a financial interest in a public relations company which provides lobbying services to the Democratic Party.

It’s been called the hush money case, but Donald Trump isn’t charged with paying hush money  because baying for somebody's silence it not a crime. It’s been called an election interference case, but that might not fully explain it, either. The main charge against Donald Trump is falsification of business records, because a composite payment to a lawyer (who is now doing jail time for perjury,) for legal tasks which included making a payment to an 'adult entertainment' actress.

Most unbiased opinion has taken the view that describing such a payment as being for 'legal services' is both accurate and legally proper. An entry in a ledger does not have to be detailed, the details are in the customer's copy of the invoice. 

Democratic Party supporters claim a more precise way to describe the case is that it’s about allegedly covering up a hush money scheme — or, allegedly covering up 2016 election interference. But the payment was not made until after the 2016 election and as previously stated, paying hush money is not a crime in the USA or the state of New York. If election law required political candidates to reveal details of all their personal dealing, there would be no political candidates.

So what has the Trump trial really been about? Here’s how Judge Juan Merchan  summarised the case for jurors:

The allegations are in substance, that Donald Trump falsified business records to conceal an agreement with others to unlawfully influence the 2016 presidential election. Specifically, it is alleged that Donald Trump made or caused false business records to  hide the true nature of payments made to Michael Cohen, by characterizing them as payment for legal services rendered pursuant to a retainer agreement. The People allege that in fact, the payments were intended to reimburse Michael Cohen for money he paid to Stephanie Clifford, also known as Stormy Daniels, in the weeks before the presidential election to prevent her from publicly revealing details about a past sexual encounter with Donald Trump.

Based on those allegations, Manhattan District Attorney Alvin Bragg charged Trump with 34 felony counts of falsifying business records in the first degree. The former president has pleaded not guilty and denies the allegations, as he has done in his other three pending criminal cases.

So, technically, it’s a falsifying business records case. Of course, that doesn’t have the same ring to it as hush money or election interference. Perhaps more importantly, that dry description doesn’t get to the heart of the matter.

The defense is not contesting the payment and the fact of the affair is not central to the allegations.

The question before the court is whether the payments were unlawfully denoted as legal expenses with the intent to somehow steal the 2016 election.

It is not a crime to use a NDA or other means to quash an embarrassing story, not to reimburse one's attorney for the purpose of negotiating such a deal even if that involves paying for sombody's silence. The only circumstances in which it would be a crime is if the person receiving the payment were a material witness in a criminal prosecution.

As Trump has already been tried for fraud in connection with this matter, and aquitted the question in this trial is: 'What crime is Trump on trial for?' There is no crime and it seems that Donald Trump's personality is on trial rather than his actions. 

However the trial hinges on the phrase 'legal expenses' used to identify a payment in the accounts of an organization in Trump's business network. How is this falsification if the payment was made to a lawyer, no matter what the services involved so long as it was within the law and the earlier acquittal proves it was  

Bill Clinton had a host of lawyers quashing allegations of affairs and sexual assaults throughout his presidency. He ran into trouble when he committed perjury in the effort to hide what Hillary Clinton called one of his “bimbo eruptions.”

Moreover, denoting this as a legal expense, on the advice of counsel, is not necessarily wrong. It is not clear how it should have been to be denoted. A “nuisance payment”? The campaign of Hillary Clinton and its general counsel Marc Elias hid the funding of the Steele dossier as a legal expense and was fined by the government for doing so. They litigated the question, insisting that that is precisely what it was and had the fine quashed.

Furthermore, falsifying accounts in New York state law is not a felony but a misdemeanour so why is Trump charged with a felony?

Given the records of Judge Merchan and AC Bragg in cases involving Trump it seems the prosecution was to stage a show trial before a biased jury to obtain a conviction the prosecution hope will keep prevent Trump from standing as Republican candidate in the 2024 election. Not only is that a blatant example of the felony of election interference, such a verdict, though certain to be overturned on appeal, would plunge the USA into a state of civil unrest in the run up to the election. And that is what the trial has really been about.
